These Terms and Conditions ("Terms") govern your use of our website www.mysouq.net (the "Website") and the "MySouq" mobile application (the "App"). Together, the Website and the App are referred to as the "Platform." By accessing, downloading, or using the Platform, you agree to comply with these Terms and all other policies referenced herein, including but not limited to our Cancellation & Refund Policy, Privacy Policy, and any other guidelines posted on the Platform from time to time.

If you do not agree to these Terms, you are requested to immediately stop using the Platform and uninstall the App. Your continued use of the Platform constitutes acceptance of these Terms.

1. Eligibility

The Platform is intended for use by:

1. Natural persons who are at least 18 years of age.
2. Legal entities (e.g., companies) authorized under the laws of Mauritania.

By using the Platform, you represent and warrant that you meet the eligibility criteria mentioned above.

2. Use of the Platform

The Platform enables users to:

• Browse and purchase goods or services from sellers ("Merchants").
• Use payment gateways to complete transactions.
• Track and manage orders.

MySouq.net acts solely as an e-commerce facilitator between buyers ("Users") and sellers ("Merchants"). We do not own or control the goods or services offered by Merchants and are not party to the contract between Users and Merchants.

Key Points:

• All commercial terms (e.g., pricing, delivery, warranties) are agreed upon directly between Users and Merchants.
• MySouq.net is not responsible for the quality, safety, suitability, or availability of the goods or services provided by Merchants.
• MySouq.net does not guarantee the performance of any Merchant or User in fulfilling their contractual obligations.

3. User Account and Personal Information

To use certain features of our Platform, you must create an account and provide accurate and up-to-date information, including:

• Name
• Phone number
• Email address
• Delivery address

You are solely responsible for maintaining the confidentiality of your account details and ensuring that your information is accurate. MySouq.net will not be liable for any unauthorized access to your account resulting from your failure to secure your credentials.

4. Orders and Delivery

1. Order Processing: Once your order is placed, it will be processed by the Merchant. The estimated delivery time provided is approximate and may vary due to circumstances beyond our control (e.g., delays at the Merchant's end, weather conditions, etc.).

2. Delivery Address: Orders will be delivered to the address provided at the time of order placement. Any changes to the delivery address after order confirmation are subject to additional charges or cancellation.

3. Delivery Responsibility:

   • Your order is deemed delivered once it reaches the specified address.
   • If you fail to accept delivery, the responsibility for the goods passes to you, and no refund will be provided.

4. Merchant Responsiveness: MySouq.net is not liable for:

   • Delayed or incorrect orders caused by the Merchant.
   • Goods not meeting your expectations.
   • Changes in pricing or availability of goods and services.

5. Payments

MySouq.net offers multiple payment options, including:

• Cash on Delivery (COD)
• Online payments via third-party payment processors

Key Payment Terms:

• Online payments are processed securely by third-party payment gateways; MySouq.net does not store your payment information.
• You are responsible for ensuring sufficient funds or credit to complete your transaction.
• Refunds, chargebacks, and cancellations will be handled according to our Refund Policy.

6. Cancellations

1. MySouq.net reserves the right to cancel any order due to:

   • Product unavailability.
   • Delivery location being out of service.
   • Other unavoidable circumstances.

2. Users may cancel orders as per the conditions outlined in our Cancellation Policy. Fees may apply to cancellations made after the Merchant has begun processing the order.

7. Prohibited Activities

You agree not to engage in any of the following activities on the Platform:

• Posting false, misleading, or unlawful content.
• Violating intellectual property or privacy rights of others.
• Engaging in fraudulent or deceptive practices.
• Using the Platform to harass, abuse, or harm others.
• Uploading harmful code, viruses, or engaging in hacking activities.
• Impersonating another person or entity.

MySouq.net reserves the right to suspend or terminate your account for any violations of these Terms.

8. Content and Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of MySouq.net or its licensors. You may not copy, reproduce, or distribute any content from the Platform without prior written consent.

9. Amendments to the Terms

MySouq.net reserves the right to update or modify these Terms at any time. Changes will be posted on the Platform, and continued use of the Platform after such changes constitutes acceptance of the updated Terms.

10. Limitation of Liability

To the fullest extent permitted by law, MySouq.net shall not be liable for:

• Any indirect, incidental, or punitive damages arising from your use of the Platform.
• Delays or disruptions in services caused by external factors beyond our control.
• Disputes between Users and Merchants.

Our total liability for any claim related to the use of the Platform will not exceed the amount paid by you for the specific transaction in question.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mauritania. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in Nouakchott, Mauritania.
